1. PARTIES

This Agreement has been signed between the parties mentioned below under the terms and conditions specified herein.

A. ‘BUYER’: (hereinafter referred to as "BUYER" in this Agreement)

By accepting this Agreement, the BUYER acknowledges that, if they confirm the order of the product, they will be obligated to pay the price of the ordered product as well as any additional charges, such as shipping fees, taxes, or other specified fees, and accepts that they have been informed about this.

2. DEFINITIONS

In the implementation and interpretation of this Agreement, the following terms shall correspond to the written explanations provided alongside them:

  • MINISTER: The Minister of Customs and Trade,
  • MINISTRY: The Ministry of Customs and Trade,
  • LAW: The Consumer Protection Law No. 6502,
  • REGULATION: The Regulation on Distance Contracts (Official Gazette: 27.11.2014/29188),
  • SERVICE: Any consumer transaction involving the provision of goods or services, other than the provision of goods for a fee,
  • SELLER: The company providing goods to the consumer within the scope of its commercial or professional activities or acting on behalf or account of the company,
  • BUYER: A natural or legal person who acquires, uses, or benefits from a good or service for non-commercial or non-professional purposes,
  • SITE: The internet site owned by the SELLER,
  • ORDERING PARTY: A natural or legal person who requests a good or service via the SELLER's internet site,
  • PARTIES: The SELLER and the BUYER,
  • AGREEMENT: This Agreement between the SELLER and the BUYER,
  • PRODUCT: Refers to the movable goods subject to the purchase and intangible goods such as software, sound, video, etc., prepared for use in electronic environments.

3. SUBJECT

This Agreement regulates the rights and obligations of the parties in accordance with the provisions of the Consumer Protection Law No. 6502 and the Regulation on Distance Contracts regarding the sale and delivery of the product, which the BUYER has ordered via the SELLER's website, with the specifications and sales price indicated below.
The prices listed and posted on the website are the sales prices. These prices and promises are valid until they are updated or changed. Prices listed for a limited time are valid until the specified duration ends.

7. PRODUCT(S) INFORMATION SUBJECT TO THE AGREEMENT

  • The basic characteristics of the product(s) (type, quantity, brand/model, color, quantity) are published on the SELLER's website. If the SELLER has organized a campaign, the basic characteristics of the relevant product(s) can be reviewed during the campaign period, which is valid until the campaign date.
  • The listed prices and the posted prices on the site are the sales prices. These prices are valid until they are updated or changed. Prices announced for a limited period are valid until the end of the specified period.
  • The total sales price of the product(s), including all taxes, is indicated below.

7.4. The shipping cost (if applicable) will be paid by the BUYER.

9. GENERAL TERMS AND CONDITIONS

9.1. The BUYER acknowledges that they have read the basic information regarding the product, its sales price, payment method, and delivery information on the SELLER's website and have given electronic confirmation, agreeing to the terms. The BUYER also acknowledges and agrees that they have received the correct and complete information regarding the products ordered, including their basic characteristics, price (including taxes), payment, and delivery details.
9.2. Each product subject to the Agreement will be delivered to the BUYER or the person or entity indicated by the BUYER within the period specified in the information section of the website, depending on the distance to the BUYER’s residence, and not exceeding 30 days. If the product cannot be delivered within this period, the BUYER has the right to cancel the Agreement.
9.3. The SELLER agrees to deliver the product as per the specifications in the order, free from defects, with any applicable warranty documents and user manuals, and in accordance with the required standards.
9.4. The SELLER may supply a different product of equal quality and price, with prior information and approval from the BUYER, if the performance of the ordered product becomes impossible.
9.5. If the SELLER is unable to fulfill the obligations of this Agreement due to impossibility, the SELLER will inform the BUYER in writing within 3 days of learning of this situation, and refund the total amount to the BUYER within 14 days.
9.6. If the product is not paid for or if payment is canceled for any reason before the delivery, the SELLER’s obligation to deliver the product is nullified.
9.7. If, after delivery of the product, it is discovered that the BUYER's credit card was used fraudulently, the BUYER agrees to return the product within 3 days at the SELLER's expense.
9.8. In cases of force majeure or unforeseen circumstances that prevent or delay delivery, the SELLER will notify the BUYER, and the BUYER may request cancellation, replacement with an equivalent product, or a delay in delivery. If canceled, the BUYER will be refunded within 14 days for cash payments and within 14 days for credit card payments.
9.9. The SELLER may contact the BUYER via their provided communication details, such as address, email, or phone, for marketing, notifications, and other purposes. By accepting this Agreement, the BUYER acknowledges and agrees to such communication.
9.10. The BUYER agrees to inspect the product before delivery and not accept any damaged or defective products. If accepted, the product will be considered free from defects.
9.11. The SELLER may request identity verification documents if there are discrepancies between the BUYER and the credit card holder. The order will be frozen until the necessary documents are provided.
9.12. The BUYER agrees that the personal and other information provided during the membership registration is accurate and that they will compensate any damages incurred by the SELLER due to inaccuracies in this information.
9.13. The BUYER agrees to comply with all applicable laws while using the SELLER’s website.
9.14. The BUYER agrees not to use the website in ways that violate public order or laws, or for harmful, illegal purposes.
9.15. The SELLER’s website may link to external sites, but it does not guarantee the accuracy or content of those sites.
9.16. If any provisions of this Agreement are violated, the violating party will be personally responsible and will indemnify the other party for any damages incurred.

10. RIGHT OF WITHDRAWAL

10.1. The BUYER has the right to withdraw from the Agreement within 14 days from the delivery of the product without any legal or penal responsibility, provided that they notify the SELLER. The withdrawal period for service contracts starts from the signing of the agreement.
10.2. The right of withdrawal must be exercised by notifying the SELLER within 14 days via registered mail, fax, or email, and the product must not have been used, as specified in the "Products for which the right of withdrawal cannot be used" section.

11. PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE USED

  • Products tailored to the BUYER's personal needs, products that cannot be returned after use for hygiene reasons (e.g., cosmetics, personal care items, underwear), consumables, or products that deteriorate quickly or are near expiry.

12. DEFAULT AND LEGAL CONSEQUENCES

In the case of default in credit card payments, the BUYER agrees to pay the interest and any costs associated with the debt under the agreement with the bank.

13. COMPETENT COURT

In case of disputes arising from this Agreement, the complaint and objections shall be made to the consumer problems arbitration board or the consumer court where the BUYER resides, based on the monetary limits specified by law.

14. FINAL PROVISIONS

This Agreement is made for commercial purposes.
